A prosecutor says the sexual abuse trial against Oregon gay rights activist Terry Bean won't happen unless the alleged 17-year-old victim is found and subpoenaed.
Clackamas County Deputy District Attorney Scott Healy told The Register-Guard they don't know where the youth is.
The 66-year-old Bean and his former boyfriend, 25-year-old Kiah Lawson, are accused of sexually abusing the teen at a Eugene hotel in 2013. A joint trial for the two is set for Aug. 11.
The teen's attorney Lori Deveny says he isn't interested in pursuing the criminal prosecution. The teen had wanted to get the case dismissed through a proposed civil settlement between him and Bean, but the judge rejected that plan last month.
Bean's attorney, Derek Ashton, said Friday in Lane County Circuit Court that he will ask the judge to dismiss the case if Healy requests a continuance.
