Kevin Clash, the openly gay man who voiced the “Elmo” puppet in the popular children's show Sesame Street, is asking a New York City court to dismiss charges accusing him of having sex with underage men.

Clash’s lawyer filed the motion on March 1, arguing that the three lawsuits for underage sex were brought onto his client years after the alleged acts happened, so the cases should be dismissed, Star Pulse reports.

“There are two applicable types of statutes of limitations, a six-year one based on when the right of action has accrued, and a three-year one based on when the alleged victim turned eighteen and was therefore no longer under the disability of being a minor,” writes attorney Michael Berger in the brief, obtained by

Clash was first accused of sexual abuse early in November of 2012 by Sheldon Stephens, a now 24-year-old struggling model with a long criminal record. Clash was found innocent.

The puppeteer resigned from the show after a second lawsuit irked Sesame Street producers, who called the controversy surrounding Clash's personal life “a distraction that none of us want.”
