Kenya Reconfirms Laws Criminalizing Gay Sex

Kenya’s high court decided on Friday to uphold laws under the penal code that criminalize gay sex, saying they do not discriminate against the LGBT community.

LGBT rights groups filed a petition in 2016 to amend two sections of the penal code: Article 162 which punishes "carnal knowledge ... against the order of nature" with up to 14 years in prison, and Article 165 which penalizes "indecent practices between males" with the possibility of five years in prison, according to NPR. The judges weren’t convinced these laws targeted LGBT people. 

"Rights cannot be trampled upon in the name of social disapproval. The Court of Appeal should revisit this ruling urgently," Neela Ghoshal, a senior LGBT rights researcher at Human Rights Watch said, according to NPR.

Activists are planning on appealing the court’s decision.
