NY Man Allegedly Called 'F*cking Faggot' By Cops is Suing NYPD for $6M

(EDGE) A gay New Yorker is suing the NYPD claiming that while he was in the middle of having an asthma attack he was grabbed by two cops, called a "f*cking faggot," placed in a chokehold and arrested. He is seeking $6 million in damages.

According to The New York Daily News, the event occurred in September 2015, when James Rolkiewicz, 53, from Staten Island was in the West Village looking for his asthma inhaler in his bag while seated on the steps of Greenwich House Music School on Barrow Street near Hudson Street.

According to the lawsuit filed Monday in Manhattan, while looking for his inhaler, two cops stepped out of an NYPD patrol car stopped alongside the curb.

In the lawsuit, Rolkiewicz alleges that while he was having an asthma attack, one of the policemen repeatedly called him a "f*cking faggot" while demanding to see his identification.

The same cop cuffed him and "repeatedly smashed his face and head into the hood of the NYPD patrol car" - while the other officer did nothing, the suit says.

The filing also says that Rolkiewicz was "brutally handled, punched, kicked, abusively treated, placed in a chokehold, handcuffed and choked until he lost consciousness," according to NYDN.

Spin4News.com reports that the two officers didn't tell Rolkiewicz why he was arrested and omitted to read him his rights, the suit states.

Rolkiewicz stayed in custody for about two days. It is unclear what charges were brought against him.

On the advice of his court-appointed attorney, Rolkiewicz, who has a two-decade-old prior conviction for manslaughter, pled guilty to a disorderly conduct violation to avoid being prosecuted for assault on a police officer.
